1. Acceptance of these Terms

These Terms of Service ("Terms") govern your use of powerafamily.org and related services operated by Power A Family ([registered legal entity name]). By using the site or making a donation, you agree to these Terms. If you do not agree, please do not use the site.

You must be at least 18 years old (or the age of majority where you live) to make a donation or create an account.

2. About Power A Family

Power A Family connects donors with verified rural Filipino families to fund solar power kits and food support. We verify families on the ground in the Philippines and aim to track each deployment from donor to delivery.

Power A Family is a charitable initiative. Our charitable-registration and tax-exemption status is described in the Donation & Refund Policy; nothing on this site should be read as a promise of tax-deductibility unless and until that status is confirmed in writing.

3. Donations are voluntary gifts

Donations are voluntary charitable gifts. You receive no goods or services in exchange for a donation. Donations are applied to our mission in accordance with our published allocation commitment and are pooled and directed to families based on need; we do not guarantee that a specific donation funds a specific family, kit, or outcome.

Funding goals, family information, and impact figures shown on the site are estimates or reflect our current data and may change.

4. No tax or legal advice; tax-deductibility

Information on the site is general and is not tax, legal, or financial advice. Whether a donation is tax-deductible depends on our registration status and your individual circumstances. Until our tax-exempt status is confirmed, you should not assume that donations are tax-deductible. Please consult your own advisor.

5. Accounts

If you create an account, you are responsible for keeping your credentials secure and for activity under your account. Notify us promptly of any unauthorized use.

6. Acceptable use

You agree not to:

  • Use the site for any unlawful, fraudulent, or harmful purpose.
  • Attempt to access data you are not authorized to access, or probe, scan, or breach our security.
  • Misrepresent your identity or impersonate any person or organization.
  • Interfere with the operation of the site or introduce malicious code.

7. Family applications

Families applying for support are subject to our Recipient Notice, which describes how applicant information is collected, verified, protected, and (with consent) shared. Submitting an application does not guarantee selection or funding.

8. Intellectual property

The site, its content, logos, and design are owned by Power A Family or its licensors and are protected by applicable laws. You may not copy, modify, or distribute them without permission, except as permitted for personal, non-commercial use.

9. Third-party services

We rely on third-party providers (for example, a payment processor, email delivery, hosting, and database services). Your use of those features may be subject to the providers’ own terms, and we are not responsible for their acts or omissions.

10. Disclaimers

The site and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure. Certain features (including online payment processing) may be in development and not yet operational.

11. Limitation of liability

To the maximum extent permitted by law, Power A Family and its officers, directors, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the site or services. Our total liability for any claim will not exceed the amount you donated in the 12 months preceding the claim, or [amount] if you made no donation.

12. Indemnification

You agree to indemnify and hold harmless Power A Family from claims arising out of your misuse of the site or violation of these Terms, to the extent permitted by law.

13. Governing law and disputes

For users and donors in the United States, these Terms are governed by the laws of the State of [State], without regard to conflict-of-laws rules, and disputes will be resolved in the courts located in [county/State] (or by [arbitration body], if arbitration is elected). For users and families in the Philippines, applicable Philippine law governs and disputes will be resolved in the proper courts of [city/province], Philippines.
